1. General Resolutions
1.1 Present resolutions comprise a regulation in the meaning of the 4th article of transport law, which prescribe requirements of servicing travelers, checking-in plus transporting people and objects.
1.2 The resolutions of the regulation are employing to international passenger transport with license which are executing by domesticated companies.
1.3 Tickets are selling by carrier’s agents.
1.4 By terms used in regulation men should comprehend:
a) Carrier – a company which execute a passenger transport on the strength of license for executing people transport;
b) Passenger – a person which takes advantage of transport service on the strength of valid ticket;
c) Baggage – objects which are bringing by traveler to a vehicle;
d) Ticket – document which authorize a person marked in this document to travel on advisable route, in precise term plus for precise price of travel;
e) Price List – current prices of tickets for travel, informations about employing discounts and baggage charge;
f) Reservation, Advance ticket sales;
g) Recovery of ticket;
h) Price List;
i) Complaints
2. The Carrier
2.1 The carrier is able to:
a) realize passenger’s transport and his baggage to set place;
b) assurance the suitable terms of safety, hygiene, comfort and high quality service for passengers;
c) assurance alternative transport in case of loss due to drive a vehicle accident and inability to continue driving;
2.2 The carrier shall make all efforts to transport the passenger and his luggage in a timely, if one has been appointed. Times of departure and arrival are subject to change, are not guaranteed and
form no part of the contract of carriage.
2.3 The carrier is not responsible for delays or cancellations due to reasons not attributable to him ( for example : border closures, natural disasters, traffic jams or at border crossings etc.), or
arising therefrom, proximate unspecified consequences.
2.4 If necessary, the carrier may change subsequent transport service operators, to change the vehicle and may, in exceptional cases, change of planting recipients.
2.5 the carrier has the right not to allow to take place in a vehicle or refuse further carriage, without having to reimburse costs incurred by the passenger in connection with travel, where passenger:
a) does not respect the terms of the contract of carriage;
b) is capable of indicating alcohol or drugs;
c) it is in the state shows that he is sick, and the effects of this disease may hazard to other passengers;
d) behaves in a manner oppressive to other passengers;
e) does not have the required documents needed to cross the border and does not apply to the customs and foreign exchange, or was not allowed into the country by immigration authorities;
f) transporting the goods, which due to the amount or type of border checks require longer and thus may cause delays in clearing the vehicle at the border.
2.6 The carrier reserves the right to refuse to carry the ticket and arrest the person who came into his possession in a manner contrary to applicable laws or regulations of the carrier or who is unable
to prove that he is a person whose personal data have been entered on the ticket.
2.7 The carrier is not liable for an incorrect address of the passenger, and reserves the right to return such a person – provided free space in the vehicle.
3. Passenger
3.1 The passenger is required to:
a) hold a valid ticket, a document entitling him to cross the border, passport and other required documents and certificates required for travel;
b) expectations at a given address at a time agreed by the carrier on the day of departure;
c) presentation of a valid ticket carrier;
d) submission to the baggage hatch on payment of fees for extra luggage;
e) use the command vehicle crew;
f) show, on appeal from the competent border police and customs documents required;
g) give an accurate address, zip code, street, house number, city, country spelling the state, which relates to the carriage.
3.2 Unless the provision of country of destination and transit travel is not otherwise provided for, children under twelve years of age must travel with an adult. In age from twelve to sixteen children
can travel alone, but must possess a notarized consent to travel independently signed by both parents or legal guardians.
3.3 Fact was not a passenger waiting at the address indicated on the day of departure within a specified period of time is tantamount to abandonment of the journey.
3.4 Traveler is required to wear safety belts in the vehicle.
3.5 In the vehicle is completely non-smoking and non-drinking alcoholic beverages.
3.6 During breaks in the journey, passengers must follow the time intervals, not to cause by their neglect the need to initiate research or delays in departure.
3.7 Passenger is insured against accidents carrier. Insurance covers only situations that may occur during their stay in the vehicle. Any random events that cause any damage, arising out of the vehicle
are not covered by such insurance.
3.8 Passengers are responsible for any damage caused to the carrier and the other passengers.
4. Baggage
4.1 Passenger has legislation to have 2 baggages without charge:
- one piece of basic baggage weighting up to 25 kg and with total dimensions 55 cm high, 25 cm width and 80 cm length, transported in the baggage hatch,
- one piece of carry-on baggage weighting up to 5 kg.
4.2 Carry-on baggage should be with total dimensions to allow free placement of baggage under the seat, the size of baggage should not hinder the travel of other passengers.
4.3 Baggage in excess of the dimensions given above will be treated as extra baggage and it will be transported for an additional fee.
4.4 Passenger has legislation to have second piece of basic baggage, but only if total weight of bought basic baggages does not exceed 35 kg.
4.5 Carrier has legislation to refuse taking baggage if the baggage does not meet the requirements of these Regulations.
4.6 Prohibits the transportation of luggage, as well as carry materials and objects that may endanger the safety of the transport, provide an opportunity to cause damage to other passengers or the
carrier and expose travelers to the discomfort.
4.7 Each time the driver of vehicle decide about taking the baggage.
4.8 The carrier is not responsible for baggage located outside the baggage hatch and for carry-on baggage.
4.9 Each piece of baggage carried in the baggage hatch should be marked by a passenger sustained a label with the given name and address.
4.10 Prohibits the carriage of goods carriage of which is prohibited under separate regulations.
4.11 The carrier in case of reasonable suspicion can check whether the contents of the luggage did not affect the above-mentioned conditions (legal basis – Article 23, paragraph 3 of the transport law).
4.12 Baggage, which can not be attributed to an individual, may be removed from the vehicle by the driver.
4.13 Passenger is full responsibility in front of the border services for his carry-on baggage, which is located in close proximity to the occupied space in the vehicle, that is, in front of, under,
next to or behind the occupied seat, on the baggage shelf above the seat and in their personal belongings.
4.14 Transport of animals in the vehicle – the dog must be muzzled and be on a leash. In order to travel freely with the dog, owner must carry documents to prove that the pet belongs to him, is healthy
and vaccinated. In the journey you should always take the dog health book. If you go abroad, the passport is also required.
4.15 The fee for excess baggage is charge by the driver.
5. Ticket
5.1 A document entitling the holder to pass a valid ticket.
a) in the case of the sell in the office: “Ticket” or “Agreement – application” called by the contract in the remainder of this Regulation Ticket.
b) in sale on-line at: www.berlineks.com, printout of the “reservation confirmation” called by the contract in the remainder of these Regulations Ticket.
5.2 The ticket is issued at the office of the carrier or the driver.
5.3 Ticket purchase is tantamount to accepting the “Contractual conditions of carriage”
5.4 Ticket types:
a) ticket-sided – it is a ticket to a specific date of departure entitling them to travel in one direction from the point of embarkation to the place of its termination;
b) two-way ticket closed (dated) – this is ticket for travel in both directions with fixed dates of departure in both directions;
c) two-way ticket “open” – is a ticket for travel in both directions, but with this difference that the ticket holder determines the date of return at any time. Ticket “open” is valid for a period of
two months from the date of the first travel, entered into the ticket. Deadline for the return journey must be declared at the place indicated by the carrier or by telephone. Reservations for a specific
date will be made as the seats in vehicle will be available.
5.5 A ticket for the sake of its validity should include:
- the name of the bearer who holds him during the journey;
- definition of final destination and the date and time of departure;
- the name of the carrier – seller;
- the amount paid for the ticket;
- the stamp of the office (agent), in which the ticket was purchased.
5.6 Ticket purchaser is required to verify the correctness of the former on the ticket.
5.7 Any changes on the ticket must be stamped and signed by the office, which made the changes.
5.8 A ticket issued by a special or promotional fare should include clear information “PROMOTION”.
5.9 Changes in ticket:
a) any changes to the ticket may be made at the site of an earlier acquisition or by the carrier agents, in the international offices, and in special cases in the Central Booking carrier;
b) reschedule your trip can be made at least 4 days prior to departure;
c) ticket can not depart without making changes in the print of ticket to other owner. Such changes may make the sales office after obtaining the consent of the carrier;
d) any changes in the ticket should be stamped and signed by the seller of the ticket, failure to comply with this formality by the passenger can cause loss of validity of the ticket;
e) the day of departure are not made any changes to the ticket;
f) charges related to changes in the ticket are listed in carrier agents.
5.10 Any damage to the ticket (flooding, collapse, ect) to the extent that it loses explicitness of reading, causes its invalidity.
6. Reservation, advance ticket sales
6.1 Advance ticket sales are possible at the earliest, one month before your planned departure.
6.2 In the sales network of the carrier does not result in a reservation without buying a ticket.
6.3 Precise information on fees and locations for sales ticket type “open” are available to points of sale of tickets and in vehicle drivers.
7. Recovery of ticket
7.1 The ticket may be refunded at point of sale, provided that the ticket is not damaged and is accompanied by a receipt from the cash register (if the sale was in its use.)
7.2 Cancellation of the journey (minus 50% of the ticket price) can occur within the four days before the date of departure. With the resignation later than 4 days prior to departure, followed a
deduction of 60% of the ticket price. An exception is the group for which shall be an individual policy. Cash reimbursement shall be in office, where the ticket was purchased.
7.3 In case of resignation of one direction of travel for two-way ticket, follows refunded the price difference between tickets bidirectional and unidirectional, with the rules as described in Section
7.2.
7.4 Shall not be refundable fee for the episodes shorter than one way and in cases where the passenger was removed from the vehicle by his fault.
7.5 Are non-refundable fee for:
a) a ticket destroyed to the extent that identification of the ticket is impossible;
b) the lost ticket, stolen ticket;
c) an unused ticket, if the abandonment of its use has been reported on the day of departure of the vehicle, just like in case of resignation from the ticket in part on the unused passage;
d) unused ticket, after the expiry of its validity.
7.6 Deductions from paid ticket price do not apply if the traveler departed from the contract of carriage of the causes occurring in the carrier.
8. Price-list
8.1 The ticket price is based on the price list in force in ticket sales. Tickets purchased are paid in Polish zloty or euro, according to the price lists are available at points of sale and for drivers
of vehicles
9. Complaints
9.1 Any incidents of complaints relating to the contract of carriage should be sent by mail to the carrier, by email or through an agent from whom you purchased the ticket.
9.2 Complaints may be made within one month of the occurrence of circumstances, which is the subject of the complaint. When reporting a complaint is necessary to describe the circumstances, concerns, or
suffered injury and related claims. For each complaint application must be accompanied by a ticket or a photocopy. Carrier reserves the term complaints to thirty days from the date of its receipt.
9.3 With personal and baggage damage the person entitled to lodge complaints and claims for the passenger, in special circumstances, his successor in title.
9.4 Complaints on baggage carried in the luggage compartment may only be submitted at the time of its release directly to the person issuing the luggage. The fact of a complaint must be confirmed by the
crew of the passenger ticket.
9.5 Baggage is not received by the passenger, if it does not contain perishable, it will be forwarded to the store for a period not longer than two months. The costs of baggage storage borne by the
passenger . If the passenger fails to call out in that time the contents of luggage will be sold and transferred to other purposes.
9.6 Items left by a passenger in the vehicle as a result of carelessness or in other circumstances not covered by the protection and liability of the carrier.
9.7 In the case of baggage loss of the carrier, the maximum amount of compensation paid on luggage can not exceed 200,00 Polish zloty or the equivalent in euros. Baggage of a value exceeding 200,00
Polish zloty should be insured by the passenger at his expense.
10. Final Provisions
10.1 In the absence of these rules are applied:
- Law of 15 November 1984 transportation law (Journal of Laws of 2000 No.50, item 601 with later amendments);
- Act of 23 April 1964 Civil Code (Journal of Laws of 1964 No.16, item 93, as amended).
10.2 The provisions of these Regulations shall come into force 05-05-2003.
